Definitions and Interpretations

In this agreement the following words will have the meanings referred to below, unless the context clearly indicates otherwise:

“App” – the Go2Africa Travel Companion travel app supported by the software of Vamoos Ltd.

“De-identify” – in relation to personal information of a user, means to delete any information that –

  • Identifies the user
  • Can be used or manipulated by a reasonably foreseeable method to identify the user; or
  • Can be linked by a reasonably foreseeable method to other information that identifies the user.

“De-identified” – has a corresponding meaning to de-identify as defined above.

“External websites” – websites not owned and operated by Go2Africa Pty Ltd or any of its affiliates.

“PAIA” – Promotion of Access to Information Act, 2000.

“Personal data” – any information which is related to an identified or identifiable natural person.

“Tailormade” – our custom built, in-house itinerary publishing client interface.

“Travel documents” – the documentation in relation to the traveller's vacation including accommodation vouchers, activity vouchers, itineraries, packing lists, e-ticket confirmations, car rental vouchers, transfer vouchers, luggage restrictions, city guides, country guides, tipping guides, walking and driving directions, etc.

“Vamoos” – SaaS partner who owns and maintains the app software. Their T&Cs are mandatory for all users and are governed by the laws of the United Kingdom.

1. Introduction

The Go2Africa Travel Companion travel app (“the App”) is designed to enhance your travel experience by providing personalised itineraries, useful travel documents, a photo journal feature, and more. The App acts as a support to Tailormade to make trip and packing information more easily accessible to all travellers on the trip. By using the App, you agree to comply with these Terms and Conditions. If you do not agree, please refrain from using the App.

2. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 18 years old or have obtained parental/guardian consent. These Terms and Conditions form a binding agreement between you and Go2Africa (Pty) Ltd (“Go2Africa”).

3. Account Access

3.1 To access the App, you may log in using a User ID and Passcode provided by Go2Africa or via Apple/Google sign-in. The User ID is generic to Go2Africa and is secured by a randomly generated password.

3.2 You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Accepting the App T&Cs, you acknowledge that Go2Africa will not be held liable for any loss of personal and/or travel information resulting from a breach of security on your device or login credentials.

3.3 Credentials are provided at an itinerary-level, which means that all party members will use the same credentials to login.

3.4 All members of the travelling party will have access to all travel documents within the App.

4. Features of the App

4.1 Itinerary and Travel Documents: View and refresh your personalised itinerary and access travel documents, including tickets and confirmations.

4.2 Notifications: Receive in-app notifications related to your travel plans. All notifications are managed in your mobile phone settings and not on the App itself.

4.3 Weather Forecast: View live weather updates and forecasts for your travel destinations.

4.4 Photo Journal: Use the Photo Journal to store images taken within the App or uploaded from your device. These images may be shared with the App's parent company solely for the purpose of ordering a printed photo book if requested. Images are not stored by the parent company beyond this purpose.

4.5 External Links: Some notifications and documents may include links that direct you outside the App. Go2Africa is not responsible for the content, security, or availability of External Websites and recommends exercising caution when accessing them.

4.6 Sharing: Share specific itinerary pages, photo journal entries, or documents to external platforms using your device's native sharing options. By sharing your itinerary pages, photo journal entries or documents, you and all other travellers in your group consent to the sharing of the documents and/or images and hereby acknowledge that Go2Africa can not be held liable for any unauthorised sharing of personal information.

5. Use of Personal Data

5.1 Personal data, including your itinerary, tickets, and photos (optionally stored within the Photo Journal), is used to provide and enhance your travel experience.

5.2 Passport information and payment information are not visible or stored within The App.

5.3 Pricing and cost information related to the trip are not visible or stored within the App.

5.4 Tickets and confirmations are shared only with your party and originate from third-party service providers facilitating your travel.

5.5 Photo Journal images are visible to Go2Africa only by logging into the App with your credentials. This will only occur under exceptional circumstances such as supporting a printed photobook order. These images are not otherwise used by Go2Africa and remain the property of the client.

6. Data Retention Policy

6.1 Your Information will not be stored longer than reasonably required to fulfil the purposes for which it is processed. However, Go2Africa may retain your information for longer periods if required for taxation purposes or with your consent to assist in providing future services (e.g., retaining preferences like bed types or meal choices for repeat customers).

6.2 You have a right to know what personal data is being stored, and processed, as well as the categories of recipients with whom it may be shared. You may contact us to learn about the contents and origin of this personal data, to verify its accuracy or to ask for this data to be supplemented, cancelled, updated or corrected, or for their transformation into an anonymous format or to block any data held in violation of the law, as well as to oppose their treatment for any and all legitimate reasons. 7. User Responsibilities

7.1 You agree to use the App solely for its intended purpose and to provide accurate and complete information when using the App. Go2Africa tracks a user's engagement on the App for analysis but all this data is de-identified.

7.2 You must not use the App for any unlawful activities or attempt to access unauthorised areas of the system.

8. Liability Disclaimer

8.1 The App is provided “as is” without warranties of any kind. Go2Africa does not guarantee the accuracy of itineraries, weather forecasts, or uninterrupted functionality of the App. Itineraries are directly received from Tailormade and thus the accuracy thereof is driven by those terms and conditions.

8.2 Go2Africa shall not be held liable for any indirect, incidental, or consequential damages resulting from your or your travel party's use of the App.

8.3 Go2Africa reserves the right to suspend or terminate access to the App if these T&Cs are violated or if we determine that continued access may pose a risk to the user or the service.

9. Modification of Terms

Go2Africa reserves the right to modify these Terms and Conditions at any time. Changes will be communicated via the App or email. Continued use of the App constitutes acceptance of the revised Terms.

10. Dispute Resolution

These Terms and Conditions are governed by the laws of the Republic of South Africa and shall be enforced by the courts within the Republic of South Africa.

Any disputes arising from your use of the App will be governed by the laws of the Republic of South Africa and resolved in a court within the Republic of South Africa.
